Man bound over in deputy’s death

A suspect in the murder of deputy Eric Overall was bound over in court on March 12 by Judge Joseph Fabrizio of 52-2 District Court.GetImage
Christopher Berak, who was charged with the first degree murder of Deputy Overall on Thanksgiving, as well as murder of a police officer, was in court to see if he would stand trial based on the evidence presented.
A video of the court preccedings was posted following Monday’s hearing.
Some of the evidence presented was a dashcam video from Overall’s car which showed a car running over the deputy, testimony from a Lapeer County Deputy and an audio recording Berak allegedly made on his phone before he was stopped by Lapeer County deputies.

After viewing the video, Berak broke down crying.
“Yes, My son’s name is Christopher Berak. I am God just so you know. I am the voice of God,” Berak said in the audio clip.
“If you charge me for a ticket for driving on the street that you paved on my planet, I will f****** kill you. Do you understand? I will f****** kill you if you try to charge me for f****** driving too fast on your f****** road. First of all, I can do whatever the f*** I want.”
Prosecutors believe that Berak was angry over a speeding ticket he had received in Shelby Township earlier in the day.
“At best, we might have reckless driving causing death,” said defense attorney Stephen Rabaut
The chase started at Lapeer County Jail where Berak allegedly walked up to the jail and claimed he was God and needed to release his followers. Police followed him in a chase, then pulled him over where he refused to put his car in park or turn it off. The chase, though Berak did not speed and made complete stops, continued down M-15, coming to an end in Oakland County where Overall was laying out stop sticks and was struck and killed by the car.
“He continued, and when he got up to the intersection there, he hit his brake and steered right,” said Lapeer County Deputy Kenneth Paul in court. “I observed the deputy be hit.”
Judge Joseph Fabrizio responded.
“I believe probable cause has been established,” he said .
