Public Notice: Atlas Township

COST RECOVERY FOR TOWED VEHICLES
ORDINANCE NO. 07-004-A
AN ORDINANCE TO RECOVER EXPENSES INCURRED WHEN THE GENESEE, COUNTY SHERIFF DEPARTMENT DEPUTIES ORDER A VEHICLE TOWED PURSUANT TO THE MICHIGAN MOTOR VEHICLE CODE.
THE TOWNSHIP OF ATLAS ORDAINS:
That this ordinance shall be amended by deleting Section 73.001 and replacing it with the following
SECTION 1
73.001 – Amount of remittance to be paid.
Sec. I. When a Genesee County Sheriff Deputy directs a vehicle to be towed because it has been:
a) Abandoned,
b) Used by a driver arrested for operating under the influence or impaired by alcohol,
c) Used by a minor in possession of alcohol,
d) Used by a driver who does not have a valid Michigan driver’s license,
e) Otherwise ordered seized by a Genesee County Sheriff Deputy,
the owner/operator of that vehicle shall remit an amount to be determined by the Township Board to Atlas Township prior to removing said vehicle from impound.
SECTION 2 — Severablity
The provisions of this ordinance are hereby declared to be severable. If any clause, sentence, word, section or provision is hereafter declared void or unenforceable for any reason by a court of competent jurisdiction, it shall not affect the remainder of such ordinance which shall continue in full force and effect.
Section 3 — Repeal
All ordinance or parts of ordinances in conflict herewith are hereby repealed.
Section 4 — Effective Date
This Ordinance shall become effective immediately upon publication.

I, Katherine Vick, the duly elected, qualified and acting clerk of the township of Atlas, Genesee County, Michigan do certify that the above Ordinance was adopted at a regular meeting of the Township Board held in the Government Center, 7386 S. Gale Road, Goodrich, Michigan on the 18th day of November, 2019 by a majority of the members of the board present and voting.
