AN ORDINANCE TO REPEAL ORDINANCE 08-02

THE MICHIGAN BUILDING AND RESIDENTIAL CODE AND REPLACE

IT WITH ORDINANCE NO. 2016- THE STATE CONSTRUCTION CODE ORDINANCE

AND TO DESIGNATE VIOLATIONS AS A MUNICIPAL CIVIL INFRACTION

The Township Of Atlas, Genesee County, Michigan hereby Ordains:

The Michigan Building and Residential Code 08-02

— shall be repealed and replaced with the following:

“Ordinance No. 2016- — State Construction Code

Section 1: Construction Code Adopted – Pursuant to the provisions of the Stille-DeRossett-Hale Single State Construction Code Act, Public Act No. 230 of 1972 (MCL 125.1501 et seq.), the Michigan State Construction Codes are hereby adopted, as are subsequent amendments.

Section 2: References in Code

– References in the Michigan State Construction Code to “State” and “Michigan” shall mean the State of Michigan; references to “municipality” shall mean the Atlas Township, references to “local ordinances” shall mean ordinances of Atlas Township, and references to “building officials” shall mean building official, building inspector, or his deputy.

Section 3 – Administration and Enforcement of State Construction Code Act and Code

– The township assumes and shall be responsible for administering and enforcing the single state construction code act, Public Act No. 230 of 1972 (MCL 125.1501 et seq.), and state construction doe prepared and promulgated as provided in that Act (referred to in this section s the state construction code and act within the boundaries of the township).

Section 4 – Violations

— Violation of this Ordinance is a municipal civil infraction.”

SECTION 1 — Repealer

All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect.

SECTION 2 – Severability

Should any section, subdivision, clause or phrase of this ordinance be declared by the courts to be invalid. The same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so invalidated.

SECTION 3 – Effective Date

This Ordinance shall become effective immediately upon publication.
