TOWNSHIP OF ATLAS
AN AMENDMENT TO THE ATLAS TOWNSHIP ZONING ORDINANCE
PERTAINING TO
VIOLATIONS AND PENALTIES
The Atlas Township Board Hereby Ordains:
PART I
300.1305 – Zoning Ordinance amendment procedures, Section 13.05 (C)(10) Conditional rezoning — is hereby deleted and replaced with the following:
10. Compliance with conditions. Any person who establishes a development or commences a use upon land that has been rezoned with conditions shall continuously operate and maintain the development or use in compliance with all of the conditions set forth in the Statement of Conditions. Any failure to comply with a condition contained within the Statement of Conditions shall constitute a violation of this Zoning Ordinance and shall be punishable un the applicable provisions of this Ordinance. No permit or approval shall be granted under this ordinance for any use or development that is contrary to an applicable State of Conditions.
PART II
300.1307 – Penalties for violation, Section 13.07 — is hereby deleted and replaced with the following:
A. Violation of the provisions of this Ordinance or failure to comply with any of its requirements, including violations of conditions and safeguards required as conditions for the grants of variances, or appeals, or conditional use permits, shall constitute a nuisance per se. Any person or legal entity that violates this Ordinance or fails to comply with any of its requirements shall be responsible for a municipal civil infraction (Atlas Township Ord 101.002).
1. Each day such violations continue shall be considered a separate offense.
2. The owner or tenant of any building, structure, premises, or part thereof, and any architect, builder, contractor, agent or other person who commits, participate in, assists in, or maintains such violation may each be found guilty of a separate offense and suffer the penalties herein provided.
3. Nothing herein contained shall prevent the Township from taking such other lawful action as is necessary to prevent or remedy any violation including, but not limited to seeking injunctive relief in any court of competent jurisdiction.
PART III
300.3B00 – Signs Ordinance, 300.3B16 – Enforcement and penalty, Section XVI (1) and (2) shall remain as fully stated therein, and (3) and (4) are hereby deleted and replaced with the following:
3. The violation and penalty provisions of Section 300.1307 of the Zoning Ordinance apply to signs.
PART IV
300.200 – Definitions, Section 2.19a. Environmental protection (1) and (2) shall remain as fully stated therein and (3) – Enforcement and penalties is hereby deleted and replaced with the following:
A. Any person violating any of the provisions of this section shall be subject to the provisions of Section 13.07, penalties for violation, in addition to any other penalties as may be prescribed herein.
PART V — Effective Date
This zoning amendment will become effective 7 days after publication. A true and complete copy of the approved amendment may be purchased or inspected at the Atlas Township Government Center, 7386 S. Gale Road, Goodrich, Michigan, during regular business hours.
