A 21-year-old Brandon Township man is facing criminal sexual conduct charges after a woman said he attempted to rape her.
Joshua Hunter Cain was arraigned March 12 on two counts of criminal sexual conduct, fourth degree in front of 52-2 District Court Judge Kelley Kostin. He was released on $5,000 bond, cash surety, 10 percent.
According to police reports, the victim walked into the Brandon substation on Feb. 26 and told deputies that her friend Joshua tried to rape her that morning, between 1 and 2 a.m. in his parents? detached garage in the 100 block of East Glass Road. The victim said Cain called her and she went to his house to listen to music and talk. After being there about 10 minutes, Cain began touching her. She told him to stop, that he couldn’t do that and they could hang out, but he couldn’t be all over her. He told her ‘no, we are? and forced her on to her back, holding her hands to her stomach with one hand while she continued to tell him to stop and struggled to free herself. She eventually did, by kneeing him in the chest.
Deputies observed bruises on the right side of the woman’s neck, her left knee, right thigh, left inner thigh and left forearm. She also had a small gouge under her belly button. Cain admitted to police that he had three 16-ounce beers, a 40-ounce beer and had taken two valiums prior to the woman’s arrival. He admitted she had told him no and that he had ‘taken things too far.?
Cain is currently on probation for embezzling $1,800 from a previous employer and also has a drunk driving conviction.
