SUMMARY OF PROPOSED OPEN SPACE OPTION
Zoning Ordinance AMENDMENT
NOTICE IS HEREBY GIVEN that at its meeting on Tuesday February 4, 2003, at 7:30 p.m., the Charter Township of Independence Board of Trustees will be considering amending the Township Zoning Ordinance, by adding a new section that would provide the option to develop certain residential property with 50% open space in order to comply with the mandates of Act No. 177 of the Public Acts of 2001. The proposed ordinance is summarized below. A true copy of the proposed Ordinance can be inspected or obtained at the office of the Charter Township of Independence Clerk, 90 North Main Street, Clarkston, Michigan.
SUMMARY OF ORDINANCE
SECTIONS AND CATCHLINES SUMMARIES
Section A – Intent and Purpose States that the purpose of the Ordinance is to encourage the long-term preservation of open space and to provide for recreation areas.
Section B – Eligibility Requirements Makes Ordinance applicable to residential properties zoned R-1A, R-1B, R-1C and R-1R, if such properties are served by municipal sewers, or to properties zoned R-1B, R-1C and R-1R, if the properties are not served by municipal sewers.
Section C – Open Space Preservation Option Provides property owners who meet eligibility requirements the option to develop the same number of dwelling units on a portion of their land that could have been developed under current zoning rules on the same land.
Section D – Density Calculations Directs that the density of the dwelling units provided by the open space option shall not exceed the density customarily developable in the applicable zoning district. The maximum density is -to be established by submittal of a parallel plan outlining how the parcel could be developed under conventional zoning district standards.
Section E – Design and Application Requirements Provides design and application requirements including: a)
preservation of a minimum of 50% of the gross site area as
open space; b) preservation of the site’s most significant
environmental, agricultural and cultural features; c) required individual lot, building, and development standards; and d) the proposed Ordinance restrictions.
Section F – Open Space
Maintenance and Preservation Requires that a conservation easement be recorded to perpetually preserve all open space.
Section G – Review Process Provides that all open space option development applications be reviewed in accordance with the proposed Ordinance and all other applicable Township procedures. Requires that all applications include a resource inventory.
Section H – Definitions Incorporates the definitions set forth in Act 177 of the Public Acts of 2001.
The proposed Ordinance also provides that the Township Zoning Ordinance shall remain in effect, amended only as provided in this proposed Ordinance. In addition, the proposed Ordinance contains a savings clause, effective date and adoption provisions.

NOTICE OF PUBLIC HEARING
On February 18, 2003 at 7:30 p.m. at the Independence Township Library, located at 6495 Clarkston Road, Clarkston, Michigan 48346, the Charter Township of Independence Board of Trustees will hold a public hearing on the Application by Consumers Energy for a Disruption Permit under the Right-of-Way Regulation Ordinance, to install approximately 3300 lineal feet of 2-inch diameter plastic medium pressure gas main along Ava Lane and Scott Circle, and approximately 1263 lineal feet of 4-inch diameter plastic medium pressure gas main along Maybee Road, to serve the Sashabaw Creek Preserve Condominium. The application is on file with the Township Clerk’s Office and may be inspected during hours said office is open for business.
