ORDINANCE NO: 16-02
AN ORDINANCE TO AMEND THE CERTAIN ATLAS TOWNSHIP ORDINANCES BY DESIGNATING VIOLATIONS AS A MUNICIPAL CIVIL INFRACTION
The Township of Atlas, Genesee County, Michigan Ordains:
SECTION 1
That the below Atlas Township Ordinances shall be amended as follows:
Ordinance No: 23
– The Peddlers and Solicitors Ordinance shall be amended by deleting Section 23.013 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 92
– The Curfew Ordinance shall be amended by deleting Section 92.401 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 96
– The Blight Ordinance shall be amended by deleting Section 96.006 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 99
– The Outside Vehicle Storage and/or Parking Ordinance shall be amended by deleting Section 99.004 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 100
– The Noise and Public Nuisance Ordinance shall be amended by deleting Section 100.007 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 162
– The Cemetery Ordinance shall be amended by deleting Section 162.006 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 192
– The Open Burning Ordinance shall be amended by deleting Section 192.009 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 194
– The Alarm Systems Ordinance shall be amended by deleting Section 194.020 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 221
– The Visible House Numbers Ordinance shall be amended by deleting Section 221.003 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 223
– The Construction Maintenance Ordinance shall be amended by deleting Section 223.009 and replacing it with the wording indicated in Section 2 below.
Ordinance No: 224
– The Severe Weather Protections Ordinance shall be amended by deleting Section 224.007 and replacing it with the wording indicated in Section 2 below.
SECTION 2
The above ordinances shall be amended by adding the following as indicated above: “Violation of this ordinance is a municipal civil infraction. In addition to pursuing a municipal civil infraction proceeding, the Township may also institute an appropriate action in a court of competent jurisdiction seeking injunctive, declaratory, or other equitable relief to enforce or interpret this Ordinance or any provision of the Ordinance. All remedies available to the Township under this Ordinance and Michigan law shall be deemed to be cumulative and not exclusive. Each day a violation of this ordinance shall exist shall be deemed a separate offense. In addition to a fine to be determined by the township board, the court, at its discretion, may award other costs, attorney’s fees, damages, expenses and other remedies as provided by law.”
SECTION 3 — Repealer
All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect.
SECTION 4 – Severabilit
y
Should any section, subdivision, clause or phrase of this ordinance be declared by the courts to be invalid. The same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so invalidated.
SECTION 5 – Effective Date
This Ordinance shall become effective immediately upon publication.
