On Nov. 18, Michael Darby, 38, was arraigned in 52-2 District Court on a Criminal Sexual Conduct, second degree charge. Bond was set at $250,000.
The charge stems from a Nov. 9 report of possible sexual misconduct towards a minor. The victim’s mother reported Darby, her boyfriend, had lived at the residence with her 6-year-old daughter since April. With the couple’s differing work schedules, Darby was often left home alone with the child.
Recently, the mother noticed the child acting withdrawn, being frightened about sleeping without her mother and avoiding situations with adult males.
After the mother talked with the child she learned that inappropriate acts constituting CSC allegedly occurred at least three times. She contacted the police on Nov. 9.
On Nov. 10, deputies went to Darby’s place of employment to bring him to the Independence Township substation for an interview, but he was not present. After checking various locations, Darby pulled up while deputies were in his parents? driveway in Springfield Township.
Deputies patted Darby down and found drug paraphernalia on him and crack cocaine in his car, according to a public information sheet released from the Oakland County Sheriff’s Office. Darby was arrested at that time and lodged in jail.
On Nov. 10, Darby was charged with possession of controlled substances, cocaine less than 25 grams and arraigned in 52-2 District Court with $50,000 bond.
The second warrant was issued after an interview with the victim.
